In this video, Fred Wahl explains the important difference between the foreign fiancé or spouse receiving Medicaid and the American sponsor receiving Medicaid.

Beginning September 18, 2026, immigration officers may consider an applicant's receipt of means-tested public benefits as one part of the overall public-charge determination. But officers are supposed to consider the totality of the circumstances, including income, assets, health, employment skills, family circumstances, and financial support available in the United States.

If the foreign fiancé or spouse personally received Medicaid, that usage may potentially become one factor in the public-charge analysis. That still does not mean automatic denial.

If the American petitioner receives Medicaid, that is different from the immigrant applicant personally receiving Medicaid. However, it could cause the officer to examine the family's overall financial circumstances more carefully.

For spouse visas, Form I-864 Affidavit of Support remains important. For K-1 fiancé visas, the sponsor submits Form I-134. But the financial review can extend beyond simply meeting the minimum income requirement.

There is also an important distinction between the foreign fiancé or spouse receiving Medicaid and the American sponsor receiving Medicaid. A sponsor receiving Medicaid does not automatically disqualify the immigrant, although the officer may examine the household's overall financial resources more closely.

Fiancé Visa vs Spouse Visa: Which Is 6 Months Faster? Fiancé Visa vs Spouse Visa: Which Is Faster? If you're trying to bring your fiancé or spouse to the United States, the difference in processing times could mean being together approximately 6 months sooner!
In this video, Fred Wahl, the VisaCoach, explains why the K-1 fiancé visa generally brings your partner to the USA faster than the CR-1 or IR-1 spouse visa.
Based on the real-world cases VisaCoach monitors, K-1 fiancé visas have typically reached visa issuance about six months sooner than spouse visas filed around the same time.
But why does the spouse visa take longer?
The difference comes down to when permanent residency is completed.
With a CR-1 or IR-1 spouse visa, your husband or wife enters the United States as a lawful permanent resident. Their physical Green Card is produced and mailed afterward.
With a K-1 fiancé visa, your partner arrives first, you marry within 90 days, and then your spouse applies for Adjustment of Status to obtain a Green Card.

I Meet 125% — Can My Spouse Visa Still Be Denied? | 2026 Public Charge Meeting 125% of the Federal Poverty Guidelines is an important part of sponsoring your spouse — but does it guarantee that the financial part of your spouse visa will be approved?
In this video, I explain why meeting the 125% income requirement may not always be the end of the financial review under the new public-charge policy.
For most spouse visa cases, the U.S. petitioner submits Form I-864, Affidavit of Support, and normally needs qualifying income of at least 125% of the applicable Federal Poverty Guideline. But the consular officer may also consider the broader financial circumstances of the case.
We discuss factors such as:
• Income stability
• Savings and financial resources
• Health
• Employment history
• Education and job skills
• Assets
• Whether a joint sponsor may help
• How the overall financial picture is presented
I also walk through two examples: one applicant who technically meets 125% but has other financial concerns, and another whose overall circumstances may present a stronger financial picture.
The important lesson is this:
Do not treat 125% as a magic approval number.
If your income is close to the requirement, you recently changed jobs, experienced unemployment, have limited savings, or have another financial issue that could raise questions, it is better to identify and document those issues before the visa interview.

2026 Spouse Visa Income Requirements: How Much Do You Need? The 2026 CR1 and IR1 spouse visa income requirement starts at $27,050 for a 2-person household in the continental United States, with higher requirements for larger households.

To qualify financially for a CR1 or IR1 spouse visa, the U.S. sponsor normally must demonstrate sufficient income under the Affidavit of Support requirements.
