With the ever increasing use of AI, (love it or hate it) it's important to know the laws pertaining to real estate media. Here are some laws recently passed in South Carolina for real estate media.
1. Sc H3448 requires the landlord to get written permission from their tenants to allow their personal belongings to be photographed for the sale of the house or condo. This also includes inspections and maintenance visits.
2. Current AI law changes: Any process that uses AI to complete the media, the media must be stated as AI processed. The unedited and AI edited should be shown. Also in this bill they included the ban of spreading intimate images. This means removing homeowners intimate photos that might be seen in media used for real estate listing media.
3. Charleston now requires a permit to take any photos that include any public property or right-of-way.
4. Some states are now banning "sky swaps" in outdoor photos.
For these reasons I think it is important for the listing agents, Brokers, and media agents to sit down from time to time and have a discussion of expectations and current laws to avoid fines.
