FAA Rules on Airspace

“State and local governments are not permitted to regulate any type of aircraft operations, such as flight paths or altitudes, or the navigable airspace.”

In simple terms if you see a drone your local and state governments only have the authority to enforce where a drone pilot can take off and land.
