Xolani Zuma has taken to Facebook claiming that he has been informed of alleged warrants of arrest against himself and his wife, March and March Movement leader Jacinta Ngobese-Zuma.

Zuma says the warrants are allegedly linked to the activities of the March and March Movement. However, he says his team is still investigating whether the information is true.

He has indicated that, if the warrants have indeed been issued, they are prepared to hand themselves over to the police today.

Zuma has also urged March and March members to remain calm, reiterating the movement’s call for peaceful solutions to South Africa’s domestic challenges.

Home Affairs To Launch Online Asylum Registration By 10 November

The Department of Home Affairs will introduce an online registration and appointment system for asylum seekers by 10 November following unrest linked to the processing of asylum applications.

Justice and Constitutional Development Minister Mmamoloko Kubayi, who chairs the Inter-Ministerial Committee on Migration, announced the plan, today Sunday.

Under the proposed system, asylum seekers will register their intention to apply for asylum through an online platform. They will receive an electronic receipt containing their personal details, biometric information, a reference number and an appointment date at a Refugee Reception Office.

The receipt will not serve as a Section 22 asylum seeker visa or grant refugee status. However, it will provide proof that a person has declared an intention to seek asylum and trigger protection against being returned to a country where they could face persecution or other serious harm.

Officials and the Border Management Authority have been instructed not to arrest, detain or deport people solely because they do not have an asylum seeker visa if they hold a valid receipt while their applications are being processed.

Assisted registration will also be available at refugee reception offices. People in police or immigration detention will be able to request assistance from officials, legal representatives and civil society organisations.

The announcement follows the withdrawal of a directive issued on 28 September that instructed Home Affairs offices to accept asylum applications from people who had entered South Africa irregularly or failed to meet previous procedural requirements.

The directive was intended to implement a Constitutional Court ruling in the Scalabrini Centre of Cape Town case, which struck down provisions that prevented people from accessing the asylum system on procedural grounds.

The directive was followed by a surge in applications at refugee reception offices, placing pressure on the department's facilities. Anti-immigration protests in Soweto and Durban subsequently turned violent, with vehicles torched and businesses targeted. Authorities have reported 30 arrests linked to the unrest.

Home Affairs Minister Leon Schreiber said the new platform would build on existing digital systems, including biometric capture and verification technology used in the electronic travel authorisation process.

Government is also preparing to approach the courts for a supervisory order and potentially a suspension period to give the department time to strengthen its administrative capacity while complying with the Constitutional Court judgment.

Deportations will continue for people who have not declared an intention to apply for asylum and those whose asylum claims have been finally rejected.

Kubayi said the approach aims to meet South Africa's constitutional obligations while ensuring that asylum applications are processed in an orderly manner and addressing public concerns.

የደቡብ አፍሪካ የሀገር ውስጥ ጉዳይ መምሪያ (Department of Home Affairs) ከጥገኝነት ጥያቄዎች አስተናጋጅነት ጋር በተያያዘ የተፈጠረውን ውጥረት ተከትሎ፣ እስከ ኖቬምበር 10 ቀን ድረስ የጥገኝነት ምዝገባና ቀጠሮ የሚያስይዝ የኦንላይን ሥርዓት ለማስጀመር አቅዷል።
የፍትሕና የሕገ መንግሥታዊ ልማት ሚኒስትር ማማሎኮኮ ኩባይ፣ የስደት ጉዳዮች ኢንተር-ሚኒስቴር ኮሚቴ ሰብሳቢ እንደመሆናቸው፣ ዕቅዱን ዛሬ እሁድ አሳውቀዋል።

2. ደረሰኙ የጥገኝነት ቪዛ ነው?
አይደለም።
የሚሰጠው ደረሰኝ የአንቀጽ 22 የጥገኝነት ጊዜያዊ ቪዛ አይደለም፤ እንዲሁም የስደተኛነት ደረጃን አይሰጥም።
ነገር ግን፣ አንድ ሰው ጥገኝነት ለመጠየቅ ፍላጎቱን እንዳሳወቀ የሚያረጋግጥ ማስረጃ ይሆናል። በተጨማሪም ወደ ሀገሩ ከተመለሰ ስደት ወይም ሌላ ከባድ ጉዳት ሊደርስበት ከሚችልበት ሀገር እንዳይመለስ የሚያግዝ የሕግ ጥበቃ ሊያስገኝለት ይችላል።
3. ደረሰኙ ያላቸውን ሰዎች ማሰር ወይም ማባረር ይቻላል?
በዜናው መሠረት፣ ባለሥልጣናትና የድንበር አስተዳደር ባለሥልጣን (Border Management Authority) ሕጋዊ የሆነ ደረሰኝ ያላቸውንና ማመልከቻቸው በሂደት ላይ ያለውን ሰዎች፣ የጥገኝነት ቪዛ የላቸውም በሚል ምክንያት ብቻ እንዳያስሩ፣ እንዳያስቀምጡ ወይም ከሀገር እንዳያባርሩ መመሪያ ተሰጥቷቸዋል።
እንዲሁም ምዝገባውን በራሳቸው ማከናወን ለማይችሉ ሰዎች በጥገኝነት ተቀባይ ጽሕፈት ቤቶች እገዛ ይሰጣል። በፖሊስ ወይም በኢሚግሬሽን እስር ላይ ያሉ ሰዎችም ከባለሥልጣናት፣ ከሕግ ባለሙያዎችና ከሲቪል ማኅበራት እገዛ መጠየቅ ይችላሉ።
4. ይህ ለምን ተወሰነ?
ይህ ውሳኔ መስከረም 28 ቀን የተሰጠውን ቀደምት መመሪያ ከመሰረዝ በኋላ የመጣ ነው። ያ መመሪያ በሕገወጥ መንገድ ወደ ደቡብ አፍሪካ የገቡ ወይም ቀደም ሲል የነበሩትን የሥርዓት መስፈርቶች ያላሟሉ ሰዎች የጥገኝነት ማመልከቻ እንዲቀበልላቸው ያስችል ነበር።
መመሪያው በኬፕታውን የስካላብሪኒ ማዕከል (Scalabrini Centre of Cape Town) ጉዳይ ላይ የተሰጠውን የሕገ መንግሥት ፍርድ ቤት ውሳኔ ለመተግበር የታሰበ ነበር። ፍርድ ቤቱ በሥርዓታዊ ምክንያቶች ብቻ ሰዎች የጥገኝነት ሥርዓቱን እንዳያገኙ የሚከለክሉ ድንጋጌዎችን ሽሯል።
ከዚያ በኋላ በጥገኝነት ተቀባይ ጽሕፈት ቤቶች የማመልከቻዎች ብዛት ጨምሯል፣ ይህም በመምሪያው ላይ ጫና ፈጥሯል። በሶዌቶና በደርባን የተካሄዱ ፀረ-ስደተኛ ተቃውሞዎችም ወደ ዓመፅ ተለውጠዋል፤ ተሽከርካሪዎች ተቃጥለዋል፣ ንግድ ቤቶችም ዒላማ ሆነዋል። ባለሥልጣናት ከዚህ ግርግር ጋር በተያያዘ 30 ሰዎች መታሰራቸውን ገልጸዋል።
5. ቀጣይ ምን ይሆናል?
የሀገር ውስጥ ጉዳይ ሚኒስትር ሊዮን ሽሬይበር አዲሱ የኦንላይን መድረክ አስቀድሞ የነበሩ ዲጂታል ሥርዓቶችን፣ የባዮሜትሪክ መረጃ መሰብሰቢያና የማረጋገጫ ቴክኖሎጂዎችን እንደሚጠቀም ተናግረዋል።
መንግሥት መምሪያው የሕገ መንግሥት ፍርድ ቤት ውሳኔን በሚያከብርበት ጊዜ የአስተዳደር አቅሙን ለማጠናከር ተጨማሪ ጊዜ እንዲያገኝ፣ ፍርድ ቤቱን የቁጥጥር ትዕዛዝና ምናልባትም ጊዜያዊ እገዳ እንዲሰጥ ለመጠየቅ እየተዘጋጀ ነው።
የጥገኝነት ፍላጎታቸውን ያላሳወቁ ሰዎችና የጥገኝነት ጥያቄያቸው በመጨረሻ ውድቅ የተደረገባቸው ሰዎች ወደ ሀገራቸው መመለሳቸው ይቀጥላል።
ሚኒስትር ኩባይ ይህ አቀራረብ የደቡብ አፍሪካን ሕገ መንግሥታዊ ግዴታዎች ለመወጣት፣ የጥገኝነት ማመልከቻዎች በሥርዓት እንዲስተናገዱ ለማድረግና የሕዝቡን ስጋት ለመቀነስ የታለመ መሆኑን ገልጸዋል።
