That's exactly what happened on Day 7 of Vice President Sara Duterte's impeachment trial.

And I want you to understand itโ€”not in legal language that confuses you, but in plain words that any Filipino can follow.

Because what happened to her family this week can happen to yours tomorrow if we let it.

Nineteen years.

Think about that number.

In 2007, Sara Duterte wasn't Vice President. She was ๐ฏ๐ข๐œ๐ž ๐ฆ๐š๐ฒ๐จ๐ซ ๐จ๐Ÿ ๐ƒ๐š๐ฏ๐š๐จ ๐‚๐ข๐ญ๐ฒ. A local official. Not the second-highest officer of the land.

The current Vice President took her oath in ๐Ÿ๐ŸŽ๐Ÿ๐Ÿ. That's only ๐Ÿ๐จ๐ฎ๐ซ ๐ฒ๐ž๐š๐ซ๐ฌ ๐š๐ ๐จ.

So here's my questionโ€”the same question any ordinary Filipino would ask:

Since when do we impeach a Vice President for actions committed before the office was even a thought in her mind?

๐–๐‡๐€๐“ ๐“๐‡๐„ ๐’๐”๐๐‘๐„๐Œ๐„ ๐‚๐Ž๐”๐‘๐“ ๐€๐‹๐‘๐„๐€๐ƒ๐˜ ๐’๐€๐ˆ๐ƒ

In 2025, the ๐’๐ฎ๐ฉ๐ซ๐ž๐ฆ๐ž ๐‚๐จ๐ฎ๐ซ๐ญ โ€”not a lawyer, not a politician, the highest court in our landโ€”ruled on Sara Duterte's first impeachment attempt.

And they said something very clear:

Let me say that again in plain Tagalog: Ang kasalanan na pwedeng ikaso sa impeachment ay dapat nangyari habang nasa pwesto ka na, at sa kasalukuyang termino mo.

That's the law. Not opinion. ๐‹๐š๐ฐ.

But the prosecution said: "Oh, that part of the ruling? That was just obiter dictumโ€”something said in passing. It's not binding."

Let me tell you something about courts. When the ๐’๐ฎ๐ฉ๐ซ๐ž๐ฆ๐ž ๐‚๐จ๐ฎ๐ซ๐ญ takes the time to write down the exact limits of what impeachment can and cannot do, that is not a casual remark. That is the Court drawing a line in the sand and saying: "๐“๐ก๐ข๐ฌ ๐Ÿ๐š๐ซ, ๐š๐ง๐ ๐ง๐จ ๐Ÿ๐š๐ซ๐ญ๐ก๐ž๐ซ."

But this week, that line was erased.

Now let me tell you about Manases Carpio.

He's a lawyer. A private citizen. He never ran for office. He never took an oath to serve the people. He never filed a Statement of Assets, Liabilities and Net Worth as a public official.

๐‡๐ž ๐ข๐ฌ ๐ง๐จ๐ญ ๐ญ๐ก๐ž ๐จ๐ง๐ž ๐›๐ž๐ข๐ง๐  ๐ข๐ฆ๐ฉ๐ž๐š๐œ๐ก๐ž๐.

But it gets worse.

Escudero didn't just authorize a subpoena for Vice President Duterte's records going back nineteen years.

Manases "Mans" Carpio. A private citizen. A lawyer. Not a Vice President. Not a Cabinet member. Not an impeachable officer.

๐€ ๐ฆ๐š๐ง ๐ฐ๐ก๐จ ๐ก๐จ๐ฅ๐๐ฌ ๐ง๐จ ๐ฉ๐ฎ๐›๐ฅ๐ข๐œ ๐จ๐Ÿ๐Ÿ๐ข๐œ๐ž is now a defendant in an Impeachment proceeding.

Here's how Escudero justified reaching a private citizen's financial records:

Therefore, his assets are legally hers, and hers are his. "It is a legal and mathematical impossibility," Escudero wrote, "to determine the respondent's true net worth without examining her husband's bank accounts."

๐‘๐ž๐š๐ฌ๐จ๐ง ๐Ÿ: Under R.A. 6713 (anti-graft law), public officials must disclose their spouses' assets. So the husband's accounts are fair game.

Yes, under Philippine family law, spouses married without a prenup share property under absolute community.

The Constitution gives the Senate power to impeach ๐ฉ๐ฎ๐›๐ฅ๐ข๐œ ๐จ๐Ÿ๐Ÿ๐ข๐œ๐ž๐ซ๐ฌโ€”not their spouses, not their property, not people connected to them by marriage.

Just because two people share property doesn't mean the government can subpoena a private citizen's financial records in an impeachment proceeding targeting someone else.

- The Vice President's parents (she might have inherited wealthโ€”better check their accounts)

- Her siblings (family businessesโ€”better subpoena them)

- Her business partners (joint venturesโ€”need to see their records too)

The prosecution keeps citing the 2012 impeachment of Chief Justice Renato Corona as precedent.

Let me show you why that doesn't work.

The Corona case shows that the Supreme Court stops unfair digging for evidence; it does not just allow politicians to look for anything they want.

That's what the Constitution demands once there is abuse of power amounting to lack or excess of jurisdiction.

Day 7 doesn't end this legal fight. It begins it.

The Supreme Court will have the final word.

And when they do, this unconstitutional subpoena will die.
