Image rights
Purchase of products or services does not confere any implicit rights to the purchaser. All images remain copyright property of Samuel K. Drayton / liquidblack photography within the provision of the Copyright, Designs and Patents Act 1988. Un-solicited or un-credited (where required) use will be subject to a discretionary fine based on context of use. No alterations may be made to any image(s) without prior written agreement. There is no right to reject on the basis of style, composition or editing unless agreed in writing, in advance.
Acknowledgement of usage
On receipt of the image(s) the Client is required to supply liquidblack photography with either a printed or digital copy of the publication for evidence of use within one month of it going to press / being published. Any printed usage of the image(s) shall be credited either on or around the image(s) or in the standard credits section of the publication. Any digital usage (for example on websites) shall be credited on the same page as the image with a hyperlink to the front page of liquidblack photography website either as part of the text or in close proximity.
Payment terms
All orders placed with liquidblack Photography, either through the online store or via any written (email, letter or similar) will be confirmed and the Client will be issued with an invoice to the registered address or email address. No orders will be shipped until payment has been received and cleared, proof of postage is not proof of delivery and Clients are recommended to use a method that affords proof of delivery.
Exceptions (for example for large or repeat orders) will only be made with written agreement from liquidblack photography. Please get in contact if you have any requests.
Any invoices issued in arrears must be paid within 14 days of the invoice date – any outstands after 14 days will receive a reminder and afford a 5% or £15 administration fee to cover costs of administration, whichever is higher. Late payment may result in any discretionary discounts being removed.
For weddings a non-refundable booking fee of 25% of the package cost to be made at the time of pre-wedding consultation, deducted from the balance. The balance will be required, at latest, 14 days prior to the wedding. All addition prints, services or further costs will be submitted after the wedding day, on a separate invoice.
Expenses
Unless specified, travel and accommodation expenses are not included in any quoted prices and will be estimated (based on mileage etc) and included in the invoice; which will be submitted after the date and location for the project has been agreed and the booking fee has been paid. Any difference owed between the Client and liquidblack photography with regards to the estimated expenses will be refunded within 30 days.
Wedding Cancellations
You may at any time choose to cancel your agreement with liquidblack photography, however the following list outlines the refund that will be due in the event of cancellation within 90 days of the Wedding day - the booking fee is non-refundable
Over 90 days: Full refund
90 – 60 days: 50% refund
60 – 30 days: 25% refund
30 – 14 days: 10% refund
14 – 7 days: 5% refund
7 – 0 days: No refund
Liability
While all reasonable care is taken to maintain high service levels liquidblack photography shall not be liable for any loss or damage suffered by the Client or by any third party arising from use or reproduction of any image(s) or its caption.
The Client agrees to indemnify liquidblack photography in respect of any claims or damages or any costs arising in any manner from the reproduction without proper reproduction rights of any image supplied to the Client. It is the Client who must satisfy themselves that all necessary rights, model releases and / or consents which may be required for reproduction are obtained and it is acknowledged that liquidblack Photography gives no warranty or undertaking that any such rights, model releases or consents have or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or works of art depicted in any image(s). In the event that any image(s) issued or reproduced by or with the authority of the Client then the Client shall indemnify liquidblack photography against any loss or damage, proceedings or costs where such rights, releases or consents have not been obtained.
Use of website
By using this website you agree to not to use in such a manner that it would cause detriment to the systems used to host it or disturb the use of it by other patrons of the site.
Privacy and data
All data that you send to liquidblack photography either through the website (including store) or via email may be stored in a data retrieval system and will be treated with the strictest confidence. The site and email systems are owned by liquidblack photography and as such will be monitored and may be logged to maintain service levels. IP addresses are recorded in parts of this site to maintain service. If you wish to contact the site owners please do so via the contact page.
